Understanding Premises Liability

Premises liability is a branch of personal injury law dealing with injuries resulting from dangerous or hazardous conditions on a piece of property. At the core of premises liability litigation is the belief (justified by law) that a property owner, be it a private homeowner or commercial corporation, is in at least some ways responsible for what goes on within the boundaries of that property. In particular, the law recognizes that property owners have an obligation to ensure that their properties - and the structures on them - are safe for others.

Premises Liability Explained

This kind of liability applies when you've had an accident while in a property that belongs to someone else. It could be another person's home, building, apartment, or any piece of land. If someone has invited you over to his or her place, that property owner should ensure that the place will be practically safe for you and the other people coming. If the property owner has failed to secure the safety of the guest in his/her property, a premises liability case could be filed against him/her.
